本期案例:双职工合同解除如何办理

  人物介绍:

  A为公司销售副总;

  B为市场部业务经理,三年前受A邀请,从原单位辞职,加入现公司;

  C为车间一线工人,B的妻子,与B为同一单位生产工人,因B辞职,同时辞职,二个月后也加入现公司;

  D为办公室主任,全面负责集团行政管理、人力资源管理工作。

  案例内容:

  三年前,为了开拓业务,刚上任的销售副总A从某公司挖来B担任某一地区的业务经理(B在原公司也负责这一地区的市场开拓、维护工作)。  

  因为B、C夫妻俩原都在一家公司,B的辞职导致C在原公司受到排挤,经B的请求,出于照顾B,A向总经理作了请示,最后同意安排C到本公司工作。事后A对B口头说明:是因为照顾B,才安排C,潜台词是说如果没有B是不会安排C的。并要求B作好分管区域的业务。
   在以上整个过程中,D作为分管人力资源的具体负责人,并没有参与,只是笼统知道,在总经理的指示下,先后为B\C办理的入职手续,签订了五年劳动合同。

   此后三年,B的业绩并不好,不仅没有完成基本指标,还一年比一年差,而与此同时,入职一年的C突然被发现得了精神方面的病。考虑到B的原因,在医疗期满后公司并没有与C解除劳动合同,而是安排C在家继续休养,并按病假待遇发放。休养一年零三个月(医疗期为三个月)(也就是入职的第三年)的C通过B要求回公司上班,但由于在此方面公司没有经验,且医院并不出具康复证明(只出具可从事简单体务劳动、继续服药的证明),公司担心出现不可控情况(此前发病时C曾出现伤人情况),所以并没有同意,继续按病假待遇给予,安排要家休养。

  第四年,由于B的业绩实在太差,每年都达到承包指标,且是持续下滑,还造成一定的损失,市场部作出调整意见(有承包协议、详细报告),但并未追究其造成的损失。经A、D讨论并报公司同意,将B调到生产一线工作,B在到生产报到后的第二天,提出因身体原因不能从事一线工作,要求再给予调岗,在提交正式申请报告后便不再上班(约一周未上班)。

   在此情况,公司作出解除与B的合同关系的决定,由于B、C是夫妻,且当时进入时是考虑B的因素才招入C的,且C现在并未完全康复,B作为C的监护人,所以同时希望与B谈有关C的解除劳动合同的事宜。
  但在整个沟通过程中,B一直强硬,提出以下问题:
  1、公司调整其工作是不合法的,因为签订的合同是业务员,要求继续从事业务员工作;
  2、个人因为不同意公司安排,也提交了申请报告,所以在等待公司决定的未上班的一周不算旷工;
  3、对于C的合同,C虽然是其妻,但C是C,自己是自己,C的合同B无权代为处理。

  本期问题:
  1、在B\C的整个人事录用过程中,A、D及总经理都有什么责任?

  2、C在医疗期满时,公司是否可以解除劳动合同?假如C在试用期出现发病,单位是否可以依此解除劳动合同,并且不需支付经济补偿?

  3、如C是部分丧失劳动能力,具备部分民事能力,公司是否可以与之协商劳动合同解除事宜?

专家点评

  本期说法问题比较多,为此,专家团仅对涉及到劳动用工管理的几个问题发表自己的一些观点:
  一、B、C的整个录用过程中,公司存在什么问题?

  蹲蹲:
  在B、C的录用过程中、公司没有对B进行背景调查,没有根据用人需求决定是否录用C,没有安排B和C做入职体检,没有对A进行面试技巧的培训,对B/C的合同期限设定不合理。
  作为销售副总,A过于依赖外来和尚,面试技巧有待提高。作为总经理,在C的录用上欠缺考虑,操之过急。副总的问题和总经理的问题属于管理技能的问题,不做细化讨论。这里主要分析人力资源总监D的问题:
  1、 招聘时的用人需求。
  用人单位进行招聘和人员录用,依据是用人部门根据生产经营状况提出的用人需求。首先有工作,然后产生了岗位,然后才产生了招聘。因岗设人而不是因人设岗。
  实践中,因为老板的关系产生“人情招聘”很难避免,作为人力资源负责人,应当提醒老板,不能随意地因为人情而录用并不需要的人。为了最大限度地避免招聘流程因为老板的关系缺失,人力资源部门可将用人需求作为一个正式文件存放在员工档案中。
  本案中,人力资源总监不考虑公司的实际用人需求而按照老板的要求直接安排员工B的家属C入职,没有尽到人员的规划的职责。
  2、 入职体检。
  用人单位在准备录用某位候选人之后,应及时安排员工到正规医院进行合法的入职体检。如果用人单位指定体检医院或体检项目,用人单位应为员工支付或报销相关的体检费用。
  用人单位可以根据医院提供的体检记录和证明来决定是否录用员工。这样可以最大限度地避免录用有严重疾病会影响工作的员工。
  本案中,人力资源总监没安排准备录用的候选人参加入职体检而直接入职,使招聘流程缺失,如果有传染病或其他疾病的候选人进入公司,将对用人单位造成极大的风险。
  3、 入职前的背景调查。
  用人单位在准备录用较为重要的岗位的候选人后,应委托外部机构或直接联系员工的上家单位,对员工进行背景调查。背景调查的内容应该包括员工的基本身份信息、员工的学习经历、工作经历,员工的品行等。
  需要注意的是,不是每个岗位都需要非常细致的背景调查,背景调查应该在征得被调查人同意后进行。
  本案中,人力资源总监没有对区域销售经理候选人B进行科学有效的背景调查,导致用人单位录用了并不胜任工作的B入职,使公司的业绩不断下滑。
  4、 面试和人员发展的培训。
  用人单位应为参与面试的管理人员进行招聘面试技巧的培训,让管理人员成为合格称职的面试专家。这样管理人员和人力资源部的招聘负责人在面试的过程中可以尽可能发现候选人存在的问题。同时,对于重要的岗位,用人单位在招聘时可以优先考虑内部转岗和提升,在内部没有合适人选的情况下,再通过外部渠道寻找。
  本案中,作为销售专家和管理人员的销售副总,A首先应该考虑的是寻找和发现公司内部适合做区域销售的人,如果实在找不到,可以从市场上寻找。而在面试的过程中,A应该发现候选人B是有问题的。
  5、 劳动合同期限的设定和试用期评估。
  用人单位为新录用的员工签订第一份劳动合同,签订的时间可以选择一年和三年。签订一年的劳动合同,用人单位可以获得两个月试用期,而在一年劳动合同结束时,可以直接终止那些并不能胜任工作的员工的劳动关系。这时用人单位只需要支付一个月工资作为补偿金。签订三年的劳动合同,用人单位可以获得六个月试用期。在六个月试用期里,用人单位可以终止不胜任工作的员工的劳动关系。
  本案中,作为人力资源总监,D设定的五年的劳动合同太长,而且试用期评估做得很差,所以没有及时发现和解决B及C的问题。

  二、作者认为,对于B,公司有三种解除劳动合同的途径:以旷工理由开除(不给补偿)、协商解除(给补偿)、未完成承包指标且造成经济损失(达到一定额度)解除(不给补偿),那一种更为合理合法?

  蹲蹲:
  B连续几年无法完成销售目标,是为不胜任工作。
  判定员工胜任工作,最重要的是为员工设定科学合理的工作目标,定义胜任工作的含义并和员工确认,签订相应的岗位目标责任书。
  如果员工不胜任工作,用人单位应为员工安排相应的培训或者安排调整工作岗位。在培训或调岗之后如果员工依然无法胜任工作,用人单位可以解除劳动合同。如果是安排培训,用人单位应该为员工安排提高员工工作能力、改进员工工作绩效有关的培训;如果是调整岗位,用人单位应为员工安排和原先工作相关的工作。用人单位没有安排培训或转岗而直接解除不胜任工作员工的劳动合同,属于违法解除劳动合同。
  本案中,判定员工B是否胜任工作,主要取决于:用人单位是否设定了科学合理的工作目标并和员工B书面确认;如果是,用人单位可以为B安排转岗,但转岗后的岗位应该和销售有关。安排从事销售管理的B去从事一线生产工作,显然不合理,员工有权利拒绝。因此员工不到一线生产岗位报到,是合理的。
  此时用人单位要做的是为员工调整岗位比如从销售经理降级到销售主管或销售人员,如果员工拒绝报到,用人单位可以以旷工或不服从工作安排为由解除劳动合同。用人单位也可以和员工进行协商解除劳动合同。至于以“未完成销售目标且造成经济损失”为由解除劳动合同,因为造成经济损失很难界定,所以很难操作,也很难被认定合法。

  三、如果C病情确无法正常交流,C的合同应如何解除才妥当?

  TOHEY:
  解除C的劳动合同,综合《劳动合同法》第四十条 以及劳办发[1994]214号《对<关于精神病患者可否解除劳动合同问题的请示>的复函》看两点:第一,法定医疗期是否满了;第二、C能否继续从事原工作也不能从事由用人单位另行安排的工作。 如果C精神方面的病情已经无法正常交流则很容易被认可不再能继续工作,且从案例看医疗期应该已满了,那么可根据《劳动合同法》第四十条及《民法通则》第十七条提前三十日书面通知其法定监护人(成年的直系亲属)解除劳动关系,并保留通知的相关证据。

  四、作为你们所在公司,是否也发生过类似事件,你们是如何处理解决的?

  TOHEY:
  本公司没有发生此类事件,一般用人跳过HR的事情是我所最不能容忍的,公司总经理也非常支持及了解这一点;当然也没有员工发生精神病。
  这个案例实质有二个需讨论的问题(实际大家心中自有答案,操作中却较难把握):
  1、 高层推荐的管理人才引进是否需严格甄选与考评,考评不合格是该如何处置?
  2、 裙带关系的考量,是否应在某一个出现问题时去考虑另一个的感受?

6.我感觉公司以协商解决还是很有前途的。其他两种方式都没有制度依据和支持,如果有也不会陷入这种境地。

一、先集中回答关于精神病患者的劳动关系解除问题(2、3、4):
精神病患者劳动关系解除操作要点:试用期发现的,可以员工不符合录用条件为由解除劳动合同,无须支付经济补偿;试用期满后发现的,用人单位按医疗期规定,给予病假,医疗期满后仍不能工作的,到劳动保障部门进行医疗鉴定,然后按鉴定结果处理。经鉴定具有劳动能力的,用人单位应适当安排其工作,不得因病解除劳动合同。经鉴定确实丧失劳动能力的,解除劳动合同,并由用人单位发给相当于员工本人标准工资3个月至6个月的医疗补助费。如果c没有正常的沟通谈判能力(案例也提到有伤人的行为),很大程度上应该属于丧失劳动能力范畴,可以支付相应补偿及补助解除。
二、再说关于B的劳动关系解除问题(5、6):
对于B未完成承包协议及造成公司损失的事实,一般都可以得到仲裁机构的支持。但在处理B的问题上,我支持湖南人的建议,要采用温和的策略妥善解决,不仅仅因为后续调岗问题考验企业管理水平(是否认定其1周旷工的事实,及旷工即可解除劳动合同),如果能妥善解决,直接有利于处理C的劳动合同解除。关于B是否可以代理C处理劳动关系解除事宜,在确认C丧失行为能力后,B作为其直系亲属,是可以代理的。
三、公司的管理漏洞(1、7):该公司人力资源没有能积极参与到公司运营当中去,导致出现明显的用工风险。当事人并没有重大过失(即使hr没有把握到处理精神病患者的关键,也没有严重影响到处理结果)。可以在市场/销售人员相关奖惩条款上下足功夫,对于不符合要求的人员采取果断措施;同时,提高hr管理水平与影响力,努力参与企业战略制定与执行层面。

1、A、D在b、c录用过程中负有“用人失察”和“凭关系用人”之责。
2、医疗期满后公司完全可在支付补偿的前提下单方面解除与c的劳动合同关系。若在试用期发病公司不能以此为由解除劳动合同,更谈不上不付补偿金了。
3、无论何种情况下公司都可以选择协商解除劳动关系,前提是公司愿意出钱支付补偿金,其二是公司具有足够的协商能力。
4、经鉴定c若无正常交流能力,则由其直系亲属如配偶、父母、子女或其他法定监护人代理。
5、b的说法纯属强词夺理,当然不排除其有个人情绪的问题。公司应对之策绝无定法,应适情适境灵活处理。
